(AP) ? It's amazing how much trouble can be stirred up in 140 characters or less.

But also how much intimacy, excitement, global scope and, yes, general zaniness. For better and for worse, the 2012 Olympics are being shaped, shaken and indisputably changed by a social media revolution that four years ago in Beijing was in its toddlerhood.

Four days into the games, we've already seen (and this is but a partial list):

?an athletes' Twitter campaign objecting to sponsorship restrictions that went viral under the hashtag "WeDemandChange."

?a television viewers uprising over Olympic broadcaster NBC's decision not to live stream the opening ceremony.

?two athletes kicked out for racist tweets.

?a fan arrested Tuesday after a series of threatening posts, including one in which he vowed to drown a British diver, and another in which he told the athlete he had failed his dead father by not winning.

For Olympics organizers who pride themselves on putting on a carefully choreographed ? obsessively controlled, some would say ? 17-day show, the bursts of Twitter activity are like gamma rays escaping from a solar flare. They're impossible to stop and spellbinding to behold.

"I don't think we would seek to control it, nor could we," said International Olympic Committee spokesman Mark Adams. He said more than 15 million fans are following and participating in the Olympic experience via Twitter and other social media platforms, not to mention a good proportion of the 10,800 athletes. "Used the right way, we embrace social media," he said. "And, if you look at the guidelines, we positively encourage it."

The problem is, it isn't always used that way.

The immediacy and public nature of Twitter and its propensity to induce off-the-cuff irreverence, and sometimes breathtaking ugliness, has added a new and chaotic element to an event where everything from urine samples to sponsors' logos to London traffic is arranged with overcaffeinated attention to detail worthy of a royal wedding.

"Though organizers have spent months touting this as the first social media Summer Games, many of them seem to have been totally unprepared for the huge impact that Twitter has had," said Andy Miah, director of the Creative Futures Institute at the University of the West of Scotland. "I think there was some naivete about the likely role of social media from both participants and from the organizers. Many of them appear to have been wrongfooted."

Twitter has been used in many ways during its brief life ? some very organized and tactical, some more spontaneous and disorderly. It has been a tool of protest and organization for the Occupy Wall Street movement and Arab Spring activists. Yet it has also led to the downfall of click-happy politicians, and the sometimes embarrassing late-night revelations of A-list celebrities.

The social network is now at the fingertips of 140 million users, up from a few million when the Olympics were held in Beijing in 2008. The San Francisco-based company says there have been more than 10 million tweets mentioning the Olympics during the first few days of the games. The exponential jump from four years ago has been driven by the rise of smartphones, now carried by spectators and athletes alike, each watching each other watch each other.

Which of course raises the question: When exuberant, often young athletes are going through the experience of their lives on one hand, and it's unfolding in a deeply controlled environment on the other, how do you make sure everyone gets what they need without it all turning to anarchy?

The IOC, Miah says, has tried to exert control by creating its own social media hub ? gathering athletes' tweets and posts from Facebook, the other formidable player in this landscape. But it hasn't always worked out as planned.

On Saturday, U.S. women's soccer goalkeeper Hope Solo launched a Twitter outburst against Brandi Chastain, the former American soccer player who is now an analyst on NBC. "Its 2 bad we can't have commentators who better represents the team&knows more about the game," Solo wrote.

Dozens of athletes, including some British soccer players, have taken to Twitter to promote their sponsors' products, a violation of Olympic rules that could theoretically lead to their expulsions. Some Olympians, undoubtedly delighting agents and marketers back home, have started an online campaign to get the rules changed.

And it's not just athletes who are stirring the stew of controversy.

British lawmaker Aidan Burley earned a sharp rebuke from fellow conservatives after he tweeted that Danny Boyle's critically acclaimed opening ceremony, which told the story of Britain's history in a rousing mix of music, symbolism and showmanship, was "leftie multicultural crap."

A British journalist said his Twitter account was blocked after he criticized NBC's coverage of the opening ceremony and posted the e-mail of a network executive. And thousands of disgruntled Olympics viewers set up hashtag "nbcfail" on Twitter to air complaints about the media company's coverage.

Then there's the teenager from Dorset who was arrested Tuesday after a series of offensive and, authorities say, menacing tweets directed at British Olympian Tom Daley. The suspect could be prosecuted under British law.

And yet Twitter has fast become an indispensable part of the Olympic scene. It is as valuable to today's spectators as programs and scorecards were to another generation, and it is just as important to the athletes seeking to connect with supporters from behind the Olympic curtain.

For young fans, "take away Twitter and you take away part of the experience," said Steve Jones, a professor who studies online culture and communications at the University of Illinois at Chicago.

Olympians have used Twitter to tell supporters what they are eating, how they are feeling and who they are hanging out with. Jamaican mega-star Usain Bolt tweeted about his craving for chicken. American hurdler Lolo Jones revealed she's a virgin.

Perhaps that is too much information and intimacy for some, but Twitter, Facebook and their many copycats are not going anywhere, and it's time we got used to it.

Andy Hunt, the head of the British Olympic association, found himself dealing with a double whammy of Twitter eruptions ? defending his star diver against social-network vitriol while vowing to look into whether the host country's soccer players should be disciplined for using the site for "ambush marketing."

"I think everyone knows, if you use social media extensively, you have to accept you get bad as well as good," Hunt told journalists. "And sometimes bad is wholly unacceptable."

NYC movie, pin-up collection slated for auction

NEW YORK (AP) ? Movie Star News amassed a staggering amount of film stills, posters and negatives over the past 73 years ? nearly 3 million, including 1,500 prints of Bettie Page, known as the queen of pin-ups. But last week, the once-lively store in lower Manhattan was lifeless. The classic movie posters that once covered its narrow 2,000-square-foot space were rolled up or covered in cellophane, its bins and racks empty. Everything was packed up in cardboard boxes that lined the floor.

The legendary Manhattan store credited with creating pin-up art had sold its entire inventory to a Las Vegas collectibles company.

The collection, regarded as one of the largest of its kind, is headed for the auction block. It will be sold in a series of sales slated to begin next year. The bulk of the collection covers the years 1939 to 1979; 11,500 movies and 5,000 actors are represented.

"This is the most important photo archive of Hollywood in existence. There are tens of thousands of negatives that have never been reproduced," said Stuart Scheinman, co-owner of Entertainment Collectibles, which bought the collection. "There are images here that have never been seen by the public."

There are 2,000 original prints and negatives of Frank Sinatra and Marlon Brando, 1,000 of Gary Cooper, 400 of Bette Davis, hundreds of movie images of "The Godfather" and "Gone With the Wind."

"This could literally take five to 10 years to go through it all," Scheinman said. He would only say the company purchased the collection for "seven figures." Its true value was anyone's guess, but he believed it easily was worth $150 million.

Movie Star News produced 8-by-10 glossy prints from the negatives, selling each for a few dollars in the store and through the mail. But the Internet has significantly cut down on demand.

"I make references to things when customers come in, and they have no idea what I'm talking about," said Ira Kramer, who took over the business that his mother, Paula, and uncle Irving Klaw, started in 1939. "Today, if you want a picture of a star you can go on the computer and download it. So what do you need me for?"

"The maintenance of the collection has been fastidious ... the way a fine library would maintain material," said Arlan Ettinger, president of Guernsey's and in charge of selling the collection.

As far back as the 1940s, Movie Star News had a mailing list of 100,000 names. World War II soldiers were big customers, buying prints for their lockers, Kramer said.

The entrepreneurial Klaw, who died in 1966, hit on the idea of selling pictures of Hollywood stars while operating a movie bookstore.

"He noticed that kids were tearing out the pictures of the movie stars, so he decided to sell their pictures rather than the books," Kramer said. Klaw started dealing directly with movie studios, RKO, Columbia and others, located in those days along Eleventh Avenue.

"He made arrangements to buy from them whatever they didn't want ... original negatives, original prints of 'Citizen Kane,' 'Three Stooges,'" he said. The studios were more than happy to be rid of the stuff for which they had no room.

Kramer's mother was the one who took the pin-up shots. But it was Klaw who launched that side of the business after a man approached him about making him a set of photographs of skimpily-clad girls posing with whips and ropes, said Kramer.

Page was Klaw's favorite model, and a suitcase of the 7-inch heels she wore in the photos, plus other bondage props, will be included in the auction.

The photos were tame by today's standards. In fact, the models were required to wear two pairs of underwear. But the FBI continuously harassed Klaw and he had to appear before the 1955 Senate Subcommittee on Obscene and Pornographic Materials.

"It was a big headache," Kramer said. Klaw finally decided to burn all the pin-up material ? but Paula Klaw saved a lot of it.

(AP) ? Metallica vocalist James Hetfield had warned things could get perilous at the start of the band's fifth tour of Mexico, saying "We're very focused on how dangerous this show is."

The audience of more than 22,000 believed it too. Many of the fans were visibly terrified Saturday night as the band re-enacted its burn-down-the-stage performance from 1998's "Cunning Stunts" video album.

At one point a technician fled across the stage like a human torch in a Mexico City show that featured explosions, pyrotechnics, laser lights and the odd giant coffin.

Hours earlier Hetfield said the tour would cover the band's 31 years of performing.

Metallica has scheduled seven more shows at Mexico City's Sports Palace before heading to dates in San Francisco and Edmonton, Canada.

Delaying surgery for localized prostate cancer ? what's the ...

A paper published in June this year in the Journal of Sexual Medicine suggests that delaying radical prostatectomy (RP) as a first-line treatment for localized prostate cancer has no significant effects on post-surgical pathology or mortality but may lead to higher risk for incontinence and erectile dysfunction. Whether this is a valid conclusion is likely to be controversial based on the data used to reach this conclusion.

The study by Sun et al. was intended to assess whether the time from diagnosis to actual surgery for men with low-grade, localized prostate cancer (clinical stage T1 or T2) had definable effects on postoperative functional outcomes and mortality in a U.S. population-based cohort derived from data in the Surveillance, Epidemiology, and End Results (SEER)-Medicare-linked database.

The authors extracted data from the SEER-Medicare database for more than 17,000 men treated by radical prostatectomy for low-grade, early stage, non-metastatic prostate cancer between 1995 and 2005. They then used statistical and other methods to look at the effect of a delay of?more than?3 months?from?diagnosis to RP on pathological upstaging at surgery (? pT3) and postoperative functional outcomes (urinary incontinence and erectile dysfunction).?They also calculated the?10-year?prostate cancer?mortality rates?for the patient sets?using cumulative incidence rates.

Here are the results stated in the abstract of the paper:

  • The total number of patients identified in the SEER-Medicare database who met the eligibility criteria was 17,153.
  • 2,576/17,153 patients (15 percent) were given an RP more than 3 months after their initial diagnosis.
  • Compared to men treated within 3 months of diagnosis, men treated > 3 months after diagnosis had
    • No evidence of increase in risk for pathological upstaging
    • No evidence of increase in risk for prostate cancer-specific mortality
    • A 24 percent higher rate of diagnosis of erectile dysfunction
    • A 33 percent higher rate of some form of procedure for erectile dysfunction
    • A 6 percent higher rate of some form of procedure?for urinary incontinence
  • Longer treatment delay (i.e., ? 3 vs. 3-5 vs. 5-9 vs. ? 9 months) was associated with a higher risk for diagnoses and/or procedures to manage erectile dysfunction and urinary incontinence.

During the period from 1995 to 2005, active surveillance was a relatively uncommon method used for the management of low-risk, localized prostate cancer. It is therefore reasonable to assume (as the authors appear to do ) that

  • Many patients diagnosed with localized prostate cancer?needed time to understand their options before making an informed decision regarding treatment.
  • Men with intermediate- and high-risk forms of localized prostate cancer would have been more likely to have received?treatment as soon as possible after their diagnosis (i.e., within 3 months) because of the presumed aggressiveness of their cancer

However, we can not necessarily take the next step that is proposed by the authors, who state that, ?The treatment delay between biopsy and RP may result in more extensive periprostatic tissue resection and may adversely affect postoperative continence and erectile function? among men who (through choice or as a consequence of scheduling) have an RP > 3 months after their initial diagnosis.

It is certainly the case that deferring treatment may have specific consequences for some men. However, the data on which the authors draw their current conclusions are highly unlikely to contain enough clinical information to know either exactly why treatment was deferred or what consequences may have been incurred as a result of the delay. It should also be noted that men defined as having ?low-risk? disease in 1995-2000 probably had somewhat more advanced cancer than those being diagnosed in 2000-2005 (let alone those being so-diagnosed today).

We should point out that we have only seen the abstract of this paper, and the full text is likely to contain all sorts of disclaimers regarding the accuracy of the results and the conclusions. The hypothesis proposed by the authors does raise questions that need to be addressed, however. We suspect there are sufficient data from various clinical registry databases to be able to directly compare the rates of incontinence and sexual dysfunction among men treated with radical prostatectomy and correlate these rates not only to time from diagnosis to surgery but also to detailed information on staging, Gleason scores, the use of active surveillance, etc.

It certainly would be disturbing if we were to see a clear association between time from diagnosis to treatment and risk for side effects of treatment in prospectively collected data from one or more large, carefully monitored cohorts of patients because it would undermine the entire premise behind the value of active surveillance ? at least for younger men who were being led to believe that ?treatment later? would be as effective and safe as ?treatment now.?

India power outage plunges 300 million into sweltering darkness

(CBS/AP) NEW DELHI - The power grid across northern India failed Monday, halting hundreds of trains and leaving millions of people sweating in the heat in one of the worst blackouts in a decade, highlighting the country's inability to feed a growing hunger for energy.

New Delhi's prestigious Metro was among rail services that went down and hospitals shifted to generator power when the country's northern grid crashed about 2:30 a.m. because it could no longer keep up with the huge demand for power in the hot summer. Residents woken from sleep when their fans and air conditioners stopped, came out of their homes in New Delhi's sweltering heat as the entire city turned dark.

By late morning, 60 percent of the power had been restored in the eight northern states affected by the outage, Power Minister Sushil Kumar Shinde said. He said he expected the rest to be back to normal by late afternoon, adding that he was forming a committee to investigate the outage.

CBS News' Sanjay Jha reports that at the peak of the outage, an estimated 300 million people across India's densely populated north were in the dark, and without power for air conditioners and fans. Delhi's ever-congested roads turned to complete gridlock in places Monday morning as traffic lights went dark. Police tried to man some of the busier intersections in the sprawling city.

Shinde announced that the government was setting up a three-member panel to look into the failure of northern power grid.

It was the first time since 2001 that the northern grid had collapsed. But India's demand for electricity has soared since then as its economy has grown sharply, and the outage was a reminder of the country's long road ahead in upgrading its infrastructure to meet its aspirations of being an economic superpower.

In addition, a weak monsoon has kept temperatures higher this year, further increasing electricity usage as people seek to cool off. Shivpal Singh Yadav, the power minister in the state of Uttar Pradesh, home to 200 million people, said that while demand during peak hours hits 11,000 megawatts, the state can only provide 9,000 megawatts.

Blackouts are a frequent occurrence in many Indian cities because of a shortage of power and an antiquated electricity grid. At the same time, tens of millions of people living in villages in northern India have no access to the electricity grid at all.

Earlier this month, angry crowds blocked traffic and clashed with police after blackouts in the Delhi suburb of Gurgaon that houses many high-rise apartment blocks and offices. With no power in some neighborhoods for more than 24 hours, people erected blockades that paralyzed traffic for several hours.

Transmission and distribution losses in some states are as much as 50 percent because of theft and connivance of employees in the power industry.

Ways to Improve Energy Efficiency











While it is possible to improve a home's energy efficiency in any climate, the predominant weather in an area has an impact on which efficiency measures will be the most valuable. For example, in especially cold areas such as Juneau or especially hot areas such as Phoenix replacement windows can cause a marked change in the cost of heating or cooling a house, whereas the impact of new windows in a more moderate climate will be less.

Any time you set out to improve your home's energy efficiency there are three dynamics to keep in mind. First, generating energy at your home from a clean source is far more efficient. Second, lighting your home more efficiently cuts down on energy consumption. Third, heating and cooling your home more efficiently is often the single most important area of overall efficiency.

The climate that you live in will, to a great degree, dictate your ability to generate power on your property. Those who live in a rainy climate, for example, won't benefit from solar panels the way that those who live in a sunny climate will. And it's pointless to install a windmill where there isn't any wind. But if you can generate power it's a good idea to do so: energy burns off in wires, so the shorter the distance is between production and plug the better.

One exception is a geothermal well, which generates power based on the exchange of heat between one end of a rod that is sunk deep into the ground and the other end of the rod, which is exposed. The temperature below the ground is fifty-six degrees Fahrenheit all the time, so any time the temperature above the ground is different (higher or lower) a geothermal well can generate electricity.

But producing power is only one way to increase efficiency. Reducing your home's consumption of power is just as important, and one of the most significant consumers of power is lighting. This can be changed by switching high efficiency light bulbs for the standard ones or by correcting bad habits. Simply turning the lights off when you leave a room can save a lot of electricity and substantially improve efficiency.

Beyond these simple fixes, it is possible to improve the way you light your home by making better use of natural light. In older homes that tend to have smaller windows, you can make a significant change by increasing the size and quantity of those windows. Even without structural changes, using mirrors to reflect (and reuse) natural light can greatly reduce your reliance on artificial lights powered by electricity.

Most people spend the most money on heating and cooling their homes, which means that heating and cooling use the most power. This can be mitigated by installing newer, more efficient equipment, as well as by improving the insulation of your home to bring it up to today's construction standards. The better insulated a home is, the less affected it is by the temperature outside.

In addition to re-insulating the home, replacing windows can demonstrably improve efficiency. The value of new windows has been well enough established that in hot places like Los Angeles and Phoenix replacement windows qualify for rebates from most utilities. Replacing the windows creates a good (and often subsidized) opportunity to expand the size of windows wherever possible, increasing the amount of natural light available inside the home.

(AP) ? Standing on Israeli soil, U.S. presidential candidate Mitt Romney on Sunday declared Jerusalem to be the capital of the Jewish state and said the United States has "a solemn duty and a moral imperative" to block Iran from achieving nuclear weapons capability.

"Make no mistake, the ayatollahs in Iran are testing our moral defenses. They want to know who will object and who will look the other way," he said. "We will not look away nor will our country ever look away from our passion and commitment to Israel."

The presidential election hovered over the speech. The Old City formed a made-for-television backdrop behind Romney, while some of his campaign donors listened in the audience.

Romney's declaration that Jerusalem is Israel's capital was matter-of-fact and in keeping with claims made by Israeli governments for decades, even though the United States, like other nations, maintains its embassy in Tel Aviv.

He did not say if he would order the embassy moved if he wins the White House, but strongly suggested so in a CNN interview.

"My understanding is the policy of our nation has been a desire to move our embassy ultimately to the capital (Jerusalem)," he said, adding, "I would only want to do so and to select the timing in accordance with the government of Israel."

His remarks on the subject during his speech drew a standing ovation from his audience, which included Sheldon Adelson, the American businessman who has said he will donate millions to help elect Romney to the White House.

Romney's embrace of Israel was on display earlier in the day when he met with Prime Minister Benyamin Netanyahu and other leaders. He also visited the Western Wall, Judaism's holiest site, where he was mobbed by worshippers. In addition, Romney met with Palestinian Prime Minister Salam Fayyad.

In his remarks, Romney steered clear of overt criticism of President Barack Obama, even though he said the threat of a nuclear-armed Iran "has only become worse" in the past five years.

In an unspoken rebuttal to Obama and other critics, Romney said, "It is sometimes said that those who are the most committed to stopping the Iranian regime from security nuclear weapons are reckless and provocative and inviting war.

"The opposite is true. We are the true peacemakers," he said.

The former Massachusetts governor also stepped back from a comment a senior aide made a short while before the speech.

"We recognize Israel's right to defend itself," he told the audience. Earlier, the aide, Dan Senor, previewed the speech for reporters, saying that "if Israel has to take action on its own, in order to stop Iran from developing the capability, the governor would respect that decision."

Israel is the second of three stops on an international trip for Romney in the weeks before he claims the Republican nomination at his party's national convention in Tampa, Fla.

He flew to the Middle East from Britain, where he caused a stir by questioning whether officials there were fully prepared for the Olympic Games. A stop in Poland will complete his trip.

Four years ago, then-U.S. Sen. Barack Obama also visited Israel as a candidate, part of a five-nation trip meant to establish his own foreign policy credentials.

In his speech, Romney said Syrian President Bashar Assad "desperately clings to power" in Damascus in the face of an attempted overthrow, but he did not call for his removal.

He noted that Egypt is now headed by an "Islamist president, chosen in a Democratic election. ... The international community must use its considerable influence to insure that the new government honors the peace agreement with Israel that was signed by the government of Anwar Sadat" more than three decades ago, he said.

A goal of Romney's overseas trip is to demonstrate his confidence on the world stage, but his stop in Israel also was designed to appeal to evangelical voters at home and to cut into Obama's support among Jewish voters and donors. A Gallup survey of Jewish voters released Friday showed Obama with a 68-25 edge over Romney.

Romney and other Republicans have said Obama is insufficiently supportive of Israel, noting statements the president has made about settlements and his handling of evident Iranian attempt to develop nuclear weapons.

Tehran is closer to developing nuclear weapons capability than before, Romney said. "Preventing that outcome must be our highest national security priority."

In a March speech before a pro-Israel lobby in Washington, Obama warned of "loose talk of war" that serves only to drive up oil prices. "Now is not the time to bluster," he said then. "Now is the time to let our increased pressure sink in and sustain the broad international coalition we have built."

It was unlikely that the day's events would settle the issue.

Obama's former press secretary, Robert Gibbs, told ABC's "This Week" that the administration has delayed Iran's nuclear program. The president has imposed U.S. penalties against Iran and worked to tougher strictures applied by other nations. There have been numerous published reports of a coordinated U.S.-Israeli cyberattack that caused damage to Iranian equipment vital to creating weapons-grade nuclear material.

Even so, Israeli Prime Minister Benjamin Netanyahu said before the speech that "all the sanctions and diplomacy so far have not set back the Iranian program by one iota."

Whatever the reality, the administration has taken steps in recent days to reassure Israel of its support.

Most notably, Obama approved an increase in assistance to strengthen a missile defense system that is designed to protect Israel from rocket attacks launched from the Gaza.

Senor's comments caused a stir in the hours leading to Romney's speech, a reminder of the controversy that Romney had created a few days earlier in London.

He later clarified his comments in a written statement, saying that the candidate "believes we should employ any and all measures to dissuade the Iranian regime from its nuclear course and it is his fervent hope that diplomatic and economic measures will do so. In the final analysis, of course, no option should be excluded."

Pentagon officials have spoken publicly about the difficulty of such a strike and American officials have expressed concern about the destabilizing effect such military action could have in the region, even if carried out successfully.

Although Facebook (FB)?met expectations in its first-ever earnings report on Thursday, the reaction from investors has been decidedly ugly so far. By the end of trading on Friday, the company?s stock price had dropped by 117% to close at $23.70, or about half the value of its 52-week peak of $45. Making things worse, Facebook?s big slide came on a day when the NASDAQ closed up 2.24%, meaning Facebook can?t plausibly blame its slide on weak U.S. GDP numbers or other external factors.

As Forbes?s?Nathan Vardi notes, Facebook was never really in an ideal situation to go public this year and investment banks used the company?s brand-name status to hype it to unreasonable expectations, especially given that no one knew whether the social networking giant had really figured out how to create a sustainable business model at the time.

And when investors learned yesterday that Facebook wouldn?t be providing any third-quarter guidance despite the fact that its capital expenditures had ballooned by 213% year-over-year, well, that just had ?sell off? written all over it.

The bottom line, then, is that investors aren?t yet convinced that Facebook knows how to make sure its large investments will pay off in terms of revenue growth. And until that happens, early Facebook shareholders will likely continue to take a bath on their investments.

In the first installment of this series, I explained the early cases
laying the conceptual groundwork for the proposition that failure to
react to bullying can constitute a denial of FAPE under IDEA.? In later installments, I have discussed the seminal decision of TK & SK ex rel LK v. New York City Dept of Educ 779 F.Supp.2d 289, 56 IDELR 228 (E.D.N.Y. 4/25/2011).? This case is important not just because it analyzes special education law principles involving bullying, but also because it provides a thorough review of the social science literature on bullying. You should read this case and you can do so here.

In the next parts of this series, I will take a look at some of the points and issues raised by participants during my recent half day presentation on Bullying at the Seattle U conference. Some big issues were discussed there.

Bullies typically operate in front of a crowd, and the students who act as onlookers do not escape the effects of bullying. These students, who often watch, or even step away from the bullying actions, are more likely to feel powerless and to be fearful at school. Macklem, supra, at 91-92. Bystanders feel as though they are incapable of controlling the situation, and thus are not themselves safe. Id. at 91.

Students may go along with the group in the bullying behavior out of fear that if they were to speak up they might lose their space within the peer group and open themselves up to be the next victim. Id. As time goes on, if bullying persists at a high level, bystanders become desensitized and are less willing to step in to prevent the harassment. Id.

Seattle reaches police reform deal with government

SEATTLE (Reuters) - Seattle officials and the Department of Justice reached a sweeping agreement on Friday to refine the use of force by police officers under a plan to be overseen by an independent, court-appointed monitor.

The settlement, which grew out of a federal investigation of the city's police department, will allow the city to avoid a civil rights lawsuit that U.S. officials threatened to bring over complaints of excessive force by officers.

Such a lawsuit would have put Seattle, considered one of the most liberal cities in the nation, among only a handful of municipalities singled out for police misconduct lawsuits by the federal government.

Instead, Seattle police will operate under a far-reaching plan that covers use of force, police stops and work bias.

The city's police were criticized in 2010 for the shooting death of an American-Indian woodcarver who appeared to pose no threat. A Department Of Justice report in December 2011 said Seattle police in the previous two years had displayed a pattern of using excessive force.

The agreement, which followed months of negotiations between city officials and the U.S. government, calls for both sides to jointly select a monitor within 60 days to oversee implementation of the plan.

"Today the real work begins, the agreement we have reached belongs to everyone in Seattle," said U.S. Assistant Attorney General Thomas Perez, head of the Justice Department's civil rights division.

"I come here with a very deep reservoir of optimism."

Seattle Mayor Mike McGinn said he was pleased with the deal. "This city is committed to eliminating bias," he said. "We do have a lot of work ahead of us."

The American Civil Liberties Union of Washington state in 2010 asked the Justice Department to probe Seattle police, citing a half-dozen incidents of excessive force, particularly against minorities. In one case, video showed a Latino man lying prone on the sidewalk when he was kicked, the group said.

FIVE-YEAR TERM

The agreement is expected to last five years, but the city may ask the federal court to terminate it before that date if Seattle's police department have been complying with it for two years, McGinn's office said.

Under the plan, the department will revise its use of force policies and enhance training, reporting and supervision, Justice Department officials said. It will also develop a team that will roll out to probe serious uses of force.

Officials will also create a civilian oversight board called the Community Police Commission. And the police department will provide guidance to officers to prohibit stops of people when officers lack reasonable suspicion.

Talks on a settlement had bogged down over the anticipated costs of implementing a Justice Department proposal, which a city memorandum estimated would run roughly $41 million for the first year alone.

The memorandum had described those expenses, including $18 million to develop and implement training programs and $11 million for new city positions, as "prohibitive."

McGinn declined on Friday to give an exact cost for implementation of the plan, but said he estimates it could be $5 million a year.

The settlement followed voluntary police reform pacts in recent years with several other big cities, including Los Angeles, Cincinnati and Pittsburgh. Several other large municipal police forces remain under federal review.

On Tuesday, U.S. Attorney General Eric Holder placed the New Orleans Police Department, accused of widespread abuses, under the scrutiny of a federal monitor for at least four years.

Police: Ripken Jr.'s mom OK after kidnapping

ABERDEEN, Md. (AP) ? Cal Ripken Jr.'s mother told a neighbor that the man who kidnapped her at gunpoint, tied her up and blindfolded her didn't seem to know she was part of a famous baseball family as the two drove around together in her car.

The gunman, who has not been found, forced 74-year-old Vi Ripken into her silver Lincoln Continental Tuesday morning and she was found bound but unharmed in the back seat about 24 hours later near her home in Aberdeen outside Baltimore, police said.

She described her abductor as a tall, thin white man with glasses wearing camouflage clothing, but police had no other details. The FBI and Maryland State Police were also involved in the investigation.

Ripken told next-door neighbor Gus Kowalewski that the gunman didn't seem to know her son was the Hall of Fame infielder nicknamed "Iron Man" for playing in 2,632 consecutive games during his 21-year career with the Baltimore.

"He said he just wanted money and her car," Kowalewski said.

Investigators do not know the kidnapper's motive and there was no ransom demand for Vi Ripken's release, Aberdeen Police Chief Henry Trabert said at a news conference.

When asked if police believe the kidnapper knew who he was abducting, Trabert did not answer, saying investigators don't know if the suspect has any ties to the Ripken family.

Kowalewski said he spoke with Vi Ripken later Wednesday morning and she told him the gunman tied her hands and put a blindfold on her, but said he wouldn't hurt her.

"He lit cigarettes for her, they stopped for food," Kowalewski said. "He said, 'I'm not going to hurt you. I'm going to take you back,' and that's what he did."

Kowalewski said Ripken told him the gunman originally planned to put tape over her eyes.

"But he didn't do that because she said 'please don't do that 'cause I'm claustrophobic,'" said Kowalewski, a 72-year-old retired autoworker.

Instead, the gunman put some type of mask or blinders on her, and she could see somewhat out the sides, he said.

Three years after voluntarily ending his Iron Man streak, Ripken Jr. retired in 2001. He is the chairman and founder of Ripken Baseball Inc., which he runs along with his brother, Bill.

He owns three minor-league baseball teams, including the Single A IronBirds based at the Ripken Baseball complex in Aberdeen, a middle-class area of about 15,000 people. Kowalewski said Ripken told him the gunman asked her about items in the car related to the Ironbirds and did not seem to know about the team.

Mike Hudson, 43, whose mother lives across the street from Ripken, said he was surprised the kidnapper came back to the neighborhood because police were swarming over the area about midnight.

"It's just hard to believe the guy came all the way back on the street and dropped her off. That makes me believe he was local, very local," said Hudson, who is staying at his mother's house while visiting with his daughter.

Ripken's car didn't appear to be damaged, he said.

"This has been a very trying time for our family, but we are grateful and relieved that mom is back with us, safe and healthy," the Ripken family said in a statement. "We want to thank everyone for their tremendous support, especially all of the law enforcement agencies that worked so hard and quickly."

Ripken's brother, Bill, played second base in the major leagues. The two were managed for a time on the Orioles by their father and Vi's husband, Cal Ripken Sr., who died in 1999.

The family said that it could not comment further due to the ongoing investigation.

After the gunman left, Ripken honked her car's horn until a neighbor found her, Kowalewski said. He said he was surprised the honking didn't wake him up. Someone reported a suspicious car to authorities and she was found, police said.

Vi Ripken is founding chairwoman of the Cal Ripken Sr. Foundation, which, according to its website, helps to build character for disadvantaged young people. Besides Cal and Bill, she has another son and a daughter.

The Ripken Baseball complex also is home to the annual Cal Ripken World Series for 11- and 12-year-olds. Cal Ripken Baseball is the name for the 5-to-12-year-old division of the Babe Ruth League.
